How we handle disabling injury claims!
 
Workers' Compensation law identifies types of injury into two (2) categories: temporary or permanent disabilities. Each disability involves lost time form work.

Temporary Disability - This type of injury may require lost time. Your condition is temporary until you reach maximum medical improvement (MMI). This means further treatment is not expected to improve your condition.

Permanent Disability - Classified as a partial or total disability where you can no longer perform your job duties.
If you are not permanently disabled, you will be released to return to work without restriction by your authorized doctor.

If you are permanently disabled, your authorized doctor will advise you about the extent of your disability. The Workers' Compensation law provides a formula to calculate a monetary award for the permanent nature of your injury.

There may be occasions when an individual with a permanent disability becomes able to return to their job with some restrictions.

Additional Information

With some disabilities you are required to work limited duty, or, if limited duty is not available, you are entitle to injury leave. Limited duty is assigned according to the physical restrictions identified by the authorized doctor. Limited duty is only available for up to 4 months from you date of injury. After 4 months you will be put on temporary total disability.

In all cases, medial benefits will continue after you have reached MMI and you claim is closed. Colorado Case law, called Grover Medicals, allows this benefit under specific and limited circumstances.

You may be entitled to a money award for a permanent partial disability in a lump sum payment or a periodic payment. The basis of the award will be explained by your claim adjuster.

If your injury involves a disfigurement, you may be entitled to a limited money award.

You will receive copies of all paperwork filed with the Division of workers' Compensation. If any of the documents are confusing to you, or you have a question about them, call the DPS Workers' Compensation Division of the Department of Human Resources (see below).

Under certain conditions, a closed claim my be reopened. Your claim adjuster can explain the process in which claims are reviewed.
